§ 1
Glossary:
1) Regulations - these regulations of the COCHO loyalty program.
2) Program - COCHO loyalty program, where participation enables the use of discounts on the prices of Goods sold in the Online Store.
3) COCHO Online Store Regulations - regulations specifying the rules of sale of COCHO Goods and the rules for using services provided electronically via the website available at www.cocho.pl. The COCHO Online Store Regulations are available at: www.cocho.pl/regulamin
4) Online Store - an online service available at www.cocho.pl, through which the Customer can purchase Goods from the Seller or use services provided electronically, as specified in these Regulations.
5) Goods - movable property presented in the Online Store, which may be the subject of a sales agreement for the Customer.
6) Account - Customer's account (Customer profile) created in the Online Store in accordance with the COCHO Online Store Regulations.
7) Customer - a natural person, having full legal capacity, a legal person, and an organizational unit not being a legal person, to whom specific provisions grant legal capacity, using the Online Store, including in particular making purchases of Goods.
8) Cart - functionality (information technology) in the Online Store, through which the Goods selected by the Customer for purchase are visible, as well as other data concerning the Customer's order, such as: the price of the Goods, quantity, order value, and which allows changing the above information and data.
9) Program Participant - a Customer using the Online Store, who meets the criteria for participation in the Program specified in these Regulations.
10) Registration Form - a service available on the Store's website, through which the Customer, by providing their personal data, creates a user account, which they can use to purchase Goods in the Online Store.
§ 2
Program
1.These regulations define the rules of operation of the COCHO loyalty program ("Program") and the conditions for participation in the Program, including the rules for granting discounts to Program participants.
2.The Program is organized and managed by Olga Idzik conducting business activity under the name: COCHO concept Olga Idzik, address of the main place of business: ul. Wigury 21, 90-319 Łódź,Poland (entrepreneur), REGON 121474980, NIP 7252342040.
3. As part of the Program, discounts will be granted to Customers of the Online Store for actions specified in these Regulations.
§ 3
Participants
A Program Participant may be a Customer who is a natural person and who has an Account in the Online Store.
§ 4
Granting discounts
1.Customers who have an Account in the Online Store will be granted discounts on Goods sold to the Customer (price discounts).
2.The amount of the discount granted for Goods covered by a given order depends on the total gross value of purchases (sum of gross prices) made by the Customer in the Online Store in the 12 months preceding the day of placing the order.
3.The amount of the discount on the gross purchase value and the thresholds for granting discounts at various levels are specified in the table below:

4. Only the gross value of orders realized, i.e., paid for and collected by the Customer, is included in the total gross purchase value.
5. The total gross purchase value does not include the shipping costs of individual orders or the gross prices of Goods sold to the Customer and subsequently returned by the Customer for any reason on any legal basis (e.g., withdrawal from the contract, Goods defect).
6. In the event that any Goods covered by the orders, the gross value of which is included in the total gross purchase value, are subsequently exchanged for other Goods, the gross prices of the Goods exchanged for the Customer are included in the total gross purchase value.
7. The total gross purchase value does not include the gross prices of orders realized by a Customer without an Account (without registration).
8. The same order can be the basis for granting a discount more than once.
9. If a discount is granted for Goods covered by a given order, when determining the total gross purchase value for the purpose of the next discount, the value of that order after the discount is taken into account.
10. The gross prices of Goods sold to the Customer by the Online Store as part of a sale (discounts) are included in the total gross purchase value, but in this case, the prices of these Goods after the discounts are taken into account.
11. A discount may also be granted for Goods subject to a sale (discounts). In such a case, the discount related to the Customer's participation in this Program is granted from the gross sale prices after the discount.
12. When placing a particular order in the Online Store, the amount of the discount is determined automatically.
13. The discount is granted automatically, and the discount amount is subtracted from the gross value of the Goods covered by the respective order. The discount amount is visible as a separate item when finalizing the order.
14. The value of the granted discount cannot be exchanged for money.
15. In the event that a Participant returns Goods in accordance with the provisions of the COCHO Online Store Regulations, the refund of costs to the Participant is made in accordance with the provisions of the aforementioned regulations, taking into account this Program, i.e., with consideration of the discount granted under the Program for each individual Good separately.
§ 5
Expiration of the discount
The granted discount expires if the Customer does not make purchases of Goods in the Online Store within 12 months before placing a given order.
§ 6
Termination of participation in the Program
1. The Customer ceases to be a participant in the Program if the Account is deleted in accordance with the rules specified in the COCHO Online Store Regulations.
2. Termination of participation in the Program leads to the expiration of the previously granted discount amount. If a Customer who is a Program Participant deletes the Account and then creates a new Account, they will not be entitled to the discount granted based on the total gross purchase value made while the Customer had the Account that was subsequently deleted.
§ 7
Complaints
1. Complaints or information about irregularities concerning participation in the Program or the granted discount should be reported to the Organizer - in writing at the address: COCHO concept Olga Idzik, ul. Wigury 21, 90-319 Łódź Poland or using the contact form on the website www.cocho.pl in the "Contact" tab.
2. The Organizer will consider the complaint immediately, no later than within fourteen days from the date of its receipt.
§ 8
Final provisions
For all rights and obligations arising from these regulations, Polish law shall apply.
§ 9
Rules for the protection of personal data within the Program. General conditions
These rules concern the processing of personal data of Program participants ("Participant"). Your personal data will be processed in accordance with the provisions on the protection of personal data, in particular in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons concerning the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).
§ 10
Personal data and the purpose of their processing
- The administrator of your personal data is Olga Idzik conducting business activity under the name COCHO CONCEPT OLGA IDZIK, ul. inż. pilota Wigury nr 21, 90-319 Łódź, with NIP: 7252342040, REGON: 121474980.
- For the purposes of participation in the Program, it is necessary for the Customer to provide the necessary data in the Registration Form, including: full name, address data, telephone number, and email address.
- In the Registration Form, the Customer may also provide additional data (information) and consent to receive commercial information electronically (in particular by providing a mobile phone number or email address) - in such a case, the Customer's personal data are processed for marketing purposes.
- The basis for processing the Customer's personal data both in the case of the Program is the Customer's consent, i.e., art. 6 sec. 1 lit. a) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons concerning the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), and in the case of personal data processed for marketing purposes - art. 6 sec. 1 lit. f) of the above-mentioned Regulation.
- The recipients of personal data will be authorized by the Administrator persons participating in the implementation of the Program by the Administrator, in particular payment operators, IT service providers.
- The Customer's personal data will be processed until the termination of the agreement for the provision of electronic services, or until the limitation period for claims under the sales contract has expired, or until the obligation to store data resulting from legal provisions has expired, in particular the obligation to keep accounting documents relating to the sales contract. In the case of personal data processed for marketing purposes, the personal data will be processed for the duration of the agreement or until objection or withdrawal of consent is made, provided that the withdrawal of consent does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal. In the case of data processed on the basis of consent, the personal data will be processed until the consent is withdrawn, provided that the withdrawal of consent does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal.
- The Customer has the right to request from the Administrator access to personal data concerning the person, their rectification, deletion, or limitation of processing, the right to object to processing, as well as the right to data portability and the right to withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.
- The Customer also has the right to lodge a complaint with the supervisory authority - the President of the Office for Personal Data Protection if you believe that the processing of personal data concerning you violates the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons concerning the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).
- Personal data provided by the Customer as part of the Program may be transferred to third countries in connection with the technical solutions used. In the case of such transfer, appropriate and proper security measures required by personal data protection regulations are applied.
- Providing personal data is voluntary, however, failure to provide them will result in the inability of the Customer to participate in the Program or receive commercial information, as referred to in para. 3 of this paragraph.
Subject to other provisions of the Regulations, the returned Goods should be labeled with a tag with the name of the Seller sewn on the outer side of the Goods.
